TERMS OF SERVICE

Khi đặt commission từ mình, bạn mặc định đã đọc và đồng ý với toàn bộ điều khoản dưới đây. Vui lòng tham khảo kỹ để đảm bảo trải nghiệm hợp tác minh bạch.

I. THÔNG TIN CẦN GỬI:1. Về nhân vật:
Số lượng nhân vật? nhân vật hư cấu/OC? Tính cách, backstory, vibe tổng thể, điểm nhấn cần thể hiện trong tranh.2. Về hình ảnh tham khảo:
Moodboard, concept art, thiết kế nhân vật. Tư thế, tương tác, đạo cụ, đồ vật đi kèm. Hình ảnh cụ thể các chi tiết đặc trưng như: trang sức, hình xăm, hoa văn…3. Về background (nếu có): Có thể mô tả hoặc cung cấp ảnh mẫu, concept muốn diễn tảLưu ý:
Không nhận ảnh mờ, sketch chưa hoàn thiện hoặc nhân vật chưa rõ thiết kế.
Bạn có thể gửi sketch để mô tả kĩ hơn.

II. QUY TRÌNH LÀM VIỆC
Sau khi đến lượt, mình thông báo trước 24H để có thời gian chuẩn bị brief, bạn có 72H để trả lời lại, qua 72H slot commission sẽ bị hủy bỏ và không hoàn cọc.
Bạn gửi yêu cầu + hình ảnh tham khảo đầy đủ.
Mình xem xét và báo giá → bạn cọc 50% giá trị tranh để giữ slot.
Mình tiến hành sketch → gửi bạn duyệt
Bạn thanh toán 50% còn lại (trong 48h) → mình hoàn thiện tranh (base màu + render).
Gửi tranh hoàn thiện → chỉnh sửa 1 lần miễn phí nếu cầnMình sẽ cập nhật tiến độ sau mỗi bước trong workflow:
• Sketch bố cục + mood
• Duyệt sketch
• Sketch sạch + base màu
• Render tranh

III. THỜI GIAN VÀ DEADLINEThời gian thực hiện: 1–3 tháng kể từ khi duyệt sketch.
Trường hợp cần kéo dài deadline do lý do cá nhân, mình sẽ thông báo và thương lượng với khách.
Nếu trễ deadline mà không báo trước, bạn có quyền yêu cầu hoàn tiền 50%.(chỉ với trường hợp đã có sketch)
Chỉ với trường hợp có deadline rõ ràng, nếu không sẽ mặc định thời gian là 1-3 tháng.

IV. CHỈNH SỬASketch: chỉnh sửa miễn phí 3 lần. (1 lần có thể sửa nhiều vùng.) Sau đó tính mỗi lần 50k nếu sửa thêm.Nếu cần thêm option sketch, miễn phí tối đa 2 option, từ option thứ 3: 10% tổng giá cho mỗi option mới.
Tranh hoàn thiện: 1 lần chỉnh sửa miễn phí → sau đó: 10% phí/lần chỉnh sửa. (tuỳ thuộc vào % muốn chỉnh sửa có thể sẽ định giá khác nhau.)
Chú Ý: Không nhận sửa thêm sau khi xuất file.Phí chỉnh sửa lớn (thay đổi tạo hình, layout, pose, background…) sẽ được tính riêng tùy mức độ, từ 10%-50%/ tổng phí.Mọi chỉnh sửa phải nằm trong phạm vi yêu cầu ban đầu. Không tiếp nhận chỉnh sửa làm thay đổi toàn bộ bố cục.

V. THANH TOÁNThanh toán qua chuyển khoản ngân hàng.Mình sẽ chỉ bắt đầu sketch sau khi nhận được cọc 50%.Sau khi duyệt sketch, bạn cần thanh toán nốt 50% còn lại trong 48h.Nếu quá thời gian quy định, đơn hàng xem như bị hủy và không hoàn tiền cọc.

VI. REFUND – HOÀN TIỀN
Trường hợp mình hủy:
Lý do cá nhân, sức khỏe,... → hoàn tiền 100%.
Do khách vi phạm TOS (trên 2 lần) → không hoàn tiền.Trường hợp bạn huỷ:
(trường hợp đầu tiên không áp dụng cho waitlist đã đặt cọc)

VII. QUYỀN SỬ DỤNG - Thương mạiArtist:
Giữ toàn bộ quyền sở hữu với tranh và các sản phẩm phụ (phác thảo, timelapse, render, v.v).Có quyền sử dụng tranh để làm portfolio, PR cá nhân, trưng bày, in ấn.Nếu bạn muốn tranh không public, vui lòng thanh toán thêm 50% phí riêng tư (private comm).

In ấn cá nhân (tối đa 10 bản vật lý)
Đăng lên mạng xã hội (bắt buộc dùng bản có watermark + credit @Shaville).Không được phép:
Gỡ watermark, nhận tranh là của bản thân vẽ.
Dùng tranh cho mục đích thương mại, kinh doanh, NFT, AI training.
Trace, chỉnh sửa, chia sẻ cho artist khác để vẽ tiếp từ tranh mình làm.
Dùng các bản sketch, WIP vào mục đích khác ngoài trao đổi công việc.

VIII. CÁC ĐIỀU KIỆN RÀNG BUỘCMỗi khách vi phạm TOS trên 2 lần có thể bị hủy commission.
Các slot waitlist:
Đặt cọc 50% giữ slot, nếu sau 3 ngày từ khi liên hệ mà không phản hồi, slot xem như bị hủy.
Nếu không lấy slot nữa, không hoàn cọc.

IX. GHI CHÚ ĐẶC BIỆT
Với commission có mức độ chi tiết cao (trang sức, thiết kế phức tạp,..) sẽ có phụ phí riêng tùy vào độ khó.
Commission thương mại: giá sẽ trao đổi tùy theo mục đích thương mại và số lượng in ấn.
Mỗi tranh comm là sản phẩm hợp tác: vui lòng theo dõi tiến độ để phản hồi kịp thời, giúp bức tranh hoàn thiện đúng như mong muốn của bạn.

By ordering a commission from me, you are considered to have read and agreed to all of the terms below. Please review them carefully to ensure a transparent and smooth collaboration.I. INFORMATION TO PROVIDE
1. About the character(s):
Number of characters? Fictional/OC?
Personality, backstory, overall vibe, and key features that should be highlighted in the artwork.2. Reference images:
Moodboards, concept art, character designs
Poses, interactions, props, accompanying items
Specific reference images for distinctive details such as jewelry, tattoos, patterns, etc.3. Background (if any):
You may describe it or provide sample images/concepts you want to portray.
Notes:
I do not accept blurry images, unfinished sketches, or characters without a clear design.
You may send sketches to describe your idea in more detail.II. WORK PROCESSWhen your turn comes, I will notify you 24 hours in advance so you have time to prepare the brief. You have 72 hours to respond; after 72 hours, the commission slot will be canceled and the deposit will not be refunded.

You send your request + all reference images.
I review and give a quotation → you pay a 50% deposit to secure your slot.
I create the sketch → send it to you for approval.
You pay the remaining 50% → I proceed to finish the artwork (base colors + rendering).
I send the completed artwork → one free revision is included if needed.

RenderingIII. TIMELINE & DEADLINESCompletion time: 1–3 months from the moment the sketch is approved.If I need to extend the deadline due to personal reasons, I will inform you and discuss it with you.If the deadline is exceeded without prior notice, you have the right to request a 50% refund (only applicable if a sketch has already been made).A specific deadline applies only if you provide one; otherwise, the default timeline is 1–3 months.

VII. USAGE RIGHTSArtist:Retains full ownership of the artwork and all related assets (sketches, timelapse, render, etc.).May use the artwork for portfolio, personal PR, display purposes.If you want the artwork to remain private, an additional 50% privacy fee is required.Client:

BINDING CONDITIONSClients who violate the TOS more than 2 times may have their commission canceled.For waitlist slots:A 50% deposit is required to hold the slot.If you do not respond within 7 days after I contact you, the slot is considered canceled.If you no longer want the slot, the deposit is non-refundable.

SPECIAL NOTESHighly detailed commissions (jewelry, complex designs, etc.) may incur an additional fee based on difficulty.For commercial commissions, the price will be discussed depending on the intended use and print quantity.Each commission is a collaborative effort: please follow the workflow and respond in a timely manner to ensure the final artwork meets your expectations.

VII. USAGE RIGHTS – Commercial Terms

Artist:
Retains full ownership of the artwork and all related materials (sketches, timelapse, renders, etc.).
Has the right to use the artwork for portfolio purposes, personal promotion, and display.
If you would like the artwork to remain private (not posted publicly), please pay an additional 50% privacy fee (private commission).Client:
Allowed:
Personal printing (up to 10 copies).
Posting on social media (must use the watermarked version and credit @Shaville).Not allowed:
Removing the watermark or claiming the artwork as your own.
Using the artwork for commercial purposes, business activities, NFT, or AI training.
Tracing, modifying, or giving the artwork to another artist to continue working on it.
Using sketches or WIP files for any purpose other than communication regarding the commission.

VIII. BINDING CONDITIONSAny client who violates the TOS more than twice may have their commission canceled.
Waitlist slots:
A 50% deposit is required to hold the slot. If you do not respond within 3 days after I contact you, the slot will be considered canceled.
If you decide not to take the slot anymore, the deposit will not be refunded.IX. SPECIAL NOTESCommissions with high levels of detail (jewelry, complex designs, etc.) will have an additional fee depending on difficulty.
Commercial commissions: pricing will be discussed based on the commercial purpose and the number of prints.
Every commission is a collaborative process: please follow the progress updates and respond in a timely manner so the artwork can be completed according to your expectations.
